Welcome to True Outdoors Gear. By accessing and using our website located at trueoutdoorsgear.com (the "Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and True Outdoors Gear Inc. ("we," "us," "our," or "Company").

If you do not agree with any part of these Terms, you must not access or use our Site, services, or purchase any products from us. Your continued use of the Site following the posting of changes to these Terms will mean you accept those changes.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

All products and services available on our Site are subject to these Terms. We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.

We reserve the right to discontinue any product at any time. Any offer for any product or service made on this Site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

By placing an order through our Site, you offer to purchase the product(s) in your cart subject to these Terms. All orders are subject to availability and confirmation of the order price. We may refuse or cancel any order for any reason at our sole discretion, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We may use third-party payment processors to process payments. By submitting your payment information, you grant us the right to provide such information to these third parties subject to our Privacy Policy. We reserve the right to refuse any order you place with us.

Shipping times provided on our Site are estimates only and actual delivery times may vary. We are not responsible for any delays in delivery that are beyond our control, including but not limited to customs delays, weather conditions, carrier delays, or other force majeure events.

Risk of loss and title for items purchased from us pass to you upon our delivery of the items to the carrier. You are responsible for filing any claims with carriers for damaged or lost shipments. We will provide reasonable assistance in such claims but are not liable for carrier errors or damages occurring during shipping.

Some products may require additional processing time or may be subject to availability constraints. In such cases, we will notify you of any significant delays. International shipping may be subject to additional customs fees, import duties, and taxes which are the responsibility of the recipient.

Our return policy is detailed separately on our Returns & Exchanges page and is incorporated into these Terms by reference. Generally, we accept returns of unused products in their original packaging within 30 days of delivery. Some products may be subject to different return conditions as specified at the time of purchase.

To initiate a return, please contact our customer service team. You are responsible for return shipping costs unless the return is due to our error or a defective product. Refunds will be processed to the original payment method within 7-10 business days of receiving the returned items.

We reserve the right to refuse returns that do not meet our return policy requirements. Sale items, clearance items, and certain outdoor equipment may have different return conditions. Please review the specific return policy for each product category before making your purchase.

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by True Outdoors Gear Inc., its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials. You may store files that are automatically cached by your Web browser for display enhancement purposes. You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THIS SITE.

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law.

You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the provincial and federal courts located in Mississauga, Ontario, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action, or proceeding arising out of these Terms.

These Terms, together with our Privacy Policy and any other legal notices published by us on the Site, shall constitute the entire agreement between you and True Outdoors Gear Inc. concerning your use of the Site. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
